JANUARY 31, 2025 – CHICAGO, IL –  Clark Raymond and Robert Raymond of Raymond & Raymond, Ltd. obtained a $9.1 million result at trial in a tragic medical malpractice case involving the preventable death of a full-term newborn due to critical failures in obstetric and nursing care.

The lawsuit alleged medical negligence by the attending obstetrician and labor and delivery nurse, who ignored clear warning signs of fetal distress and failed to act when intervention was urgently needed. Despite clear signs of distress, the doctor delayed placing a fetal scalp electrode, improperly instructed the mother to labor down, and waited too long to perform a Cesarean section. Meanwhile, the nurse failed to push for intervention or escalate concerns to the hospital chain-of-command, despite repeatedly warning the doctor about worrisome monitoring.

After reviewing the overwhelming evidence, the jury found both the doctor and the nurse guilty of medical negligence, awarding $7.5 million in damages, with pretrial interest bringing the total to $9.1 million for the family.
